Can I publish a book with photos of my old baseball cards? Are there copyright issues?

The book would be a coffee table-style book with the cards as the photos and brief descriptions of the players on them.

Simple answer: beware, republication of copyrighted works could be an infringement, resulting in damages, injunction, seizure of the books, and possible criminal penalties.

Complicated answer: copyright laws have changed over the years and the copyright duration for your cards may vary. Some prior to 1923 may have no copyright at all. Others would have to have been published with copyright notice and/or registration (up until the 1970s), and after 1979 everything is automatically copyrighted for 120 years from date of first publication (or 70 years after death of the author, in this case the photographer, if s/he is an individual and not a corporation).

So, in summary, you (or your publisher) will need to know when each card was published in the USA, who the author is, whether it had copyright notice or registration (prior to statutory cutoff dates), etc.

You or your publisher will own the copryight to the “collective” work, but not the copyright of the underlying works.

Copyright can be transferred or portions of it licensed, so you may also run into another publisher who already has the “exclusive” rights to publish, although it’s not the registered owner of the copyright.

Note also that the “facts” printed with each card are not protected by copyright, although their selection and arrangement might be. So you can freely transcribe “facts” to your own use, but you can’ t simply make a photocopy of the facts on the card without the same analysis of who created the card, when it was published, etc.

Are there any valuable baseball cards from the early 1990s?

I found a box of over 1,000 baseball cards, all from 1991-1993. I can’t find any trading card shop willing to sort through them all, so I want to do it myself – donate the worthless ones and sell any that might be worth a little bit.

This was the era when the card companies were just beginning to figure out that is was not a good idea to print 3 million sets. Production was lower than previous years, but still pretty high.

There were several rookies in regular sets from that era that are worth a few dollars. 1991 – Luis Gonzalez, Mike Mussina. 1992 – Jeff Bagwell, Trevor Hoffman, Carlos Delgado, Garret Anderson, Mariano Rivera, Mike Piazza, Manny Ramirez, Cliff Floyd, Shawn Green. 1993- Andy Pettitte, Jason Kendall, Preston Wilson, and, of course, Derek Jeter.

The Traded/Update sets would have had most of these players a year earlier.

If you bought these cards in the usual retail outlets, you probably have Topps, Upper Deck, Donruss, Fleer or Score. Most of these rookies top out at about $2 in the mainstream sets. Bowman rookies are significantly higher.

As far as veterans, there weren’t that many that were worth a lot in that era. Most of them, Bonds, Ripken, Ryan, etc. top out around $1 – $2.

Inserts and smaller production sets have some higher value as well, but you are looking at short printed Jeter or Ramirez rookies before you get into the big bucks.

Overall, not the best era, but there could be a few good finds in there.

Topps 2009 MLB Cubs team card set?

does anyone have the 2009 team set of baseball cards for the cubs? I need to know who the 14 players in the pack are before I buy it. I want to send cards into spring training and I need to know which player’s card I will get in the pack. Thanks
